1. Acceptance of these terms
By using this website or engaging Mayes Digital for services, you agree to these Terms of Use and any separate proposal, statement of work, or service agreement that applies to your project.
2. Services and project scope
Mayes Digital provides website design, website care, local visibility support, lead-management setup, and related digital services. Deliverables, timing, revisions, fees, and responsibilities are defined in the applicable proposal or agreement. Project timing is an estimate and may change based on scope, client responsiveness, approvals, integrations, or third-party dependencies.
3. Client responsibilities
Clients are responsible for providing accurate business information, content, access, approvals, and materials they have the right to use. Delays in receiving required materials or decisions may affect the schedule.
4. Fees, payments, and cancellation
Fees, deposits, recurring charges, payment timing, cancellation terms, and refund eligibility are governed by the applicable proposal or service agreement. Third-party platform, domain, messaging, hosting, or usage charges may be separate when disclosed.
5. Ownership and licenses
Ownership of final deliverables is determined by the applicable agreement and begins only after required payments and obligations are completed. Mayes Digital retains ownership of pre-existing tools, systems, methods, reusable components, and licensed third-party materials. The Launch & Own option is intended to provide ownership of the agreed website deliverable after the project terms are satisfied.
6. Third-party services
Projects may use services provided by Webflow, GoHighLevel, domain registrars, analytics providers, email or messaging platforms, and other vendors. Those services are governed by their own terms, availability, pricing, and policies. Mayes Digital is not responsible for third-party outages or changes outside its control.
7. Results disclaimer
Mayes Digital does not guarantee search rankings, traffic, leads, booked work, revenue, or other business outcomes. Services are designed to improve controllable areas such as clarity, credibility, accessibility, organization, visibility foundations, and customer follow-up.
8. Communications
If you request contact or consent to communications, Mayes Digital may respond by email, phone, or text as permitted by your choices and applicable law. Message and data rates may apply. Consent to marketing communications is not a condition of purchase, and you may opt out of promotional texts by replying STOP.
9. Acceptable use
You may not misuse the website, interfere with its operation, attempt unauthorized access, submit malicious code, impersonate another person, or use the site in violation of applicable law.
10. Disclaimer and limitation of liability
The website is provided on an “as available” basis. To the fullest extent permitted by law, Mayes Digital disclaims implied warranties and is not liable for indirect, incidental, special, consequential, or punitive damages arising from use of the website or third-party services. Any service-specific liability terms in a signed agreement control where they differ from this section.
11. Changes and governing law
These terms may be updated by posting a revised effective date. Unless a separate agreement states otherwise, these terms are governed by the laws of Tennessee, without regard to conflict-of-law principles.
